Terms of Service

1. Acceptance of Terms of Service Agreement

By creating a "PolaFrame for Instant Lab" account, whether on a mobile device, a mobile application, or a computer (collectively, the "Service"), you agree to be bound by (i) these Terms of Service, (ii) our Privacy Policy, and our Cookie Policy, each incorporated by reference into this Agreement, and (iii) any terms disclosed and agreed to by you if you purchase additional features, products, or services we offer on the Service (collectively, this "Agreement").

If you do not accept and agree to be bound by all of the terms of this Agreement, please do not use the Service. We may modify this Agreement and the Service at any time. We may do so for various reasons, including to reflect changes in the law or its requirements, new features, or changes in business practices.

The most recent version of this Agreement will be posted in the dedicated section of the application, and we suggest you regularly consult the most recent version. The most recent version is the one that applies. If the modifications include material changes that affect your rights or obligations, we will notify you in advance of such changes by reasonable means, which may include notifications through the Service or by email. Use of the Service after the modifications take effect constitutes acceptance of the revised Agreement.

2. Your Account

To use "PolaFrame for Instant Lab," you may log in using your Facebook or Google ID. If you do so, you authorize us to access and use certain information from your Facebook or Google account, including your public Facebook profile. For more information regarding the information we collect from you and how we use it, please consult our Privacy Policy.

You are responsible for maintaining the confidentiality of the login credentials you use to register for "PolaFrame for Instant Lab," and you are solely responsible for all activities occurring under those credentials. If you believe someone has accessed your account, please contact us immediately via the dedicated section in our application.

3. Modification of Service and Termination

"PolaFrame for Instant Lab" strives to continuously improve the Service and bring you additional features that you will find interesting and useful. This means we may add new product functions or enhancements at any time, and we may also remove certain functions.

In cases where such actions do not materially affect your rights or obligations, we may not notify you before applying them. We may even suspend the Service entirely, in which case we will notify you in advance unless extenuating circumstances, such as safety or security issues, prevent us from doing so.

To terminate your account, please contact us. However, if you use a third-party payment account, you must manage purchases on the application via that account (iTunes, Google Play, etc.) to avoid any additional billing. "PolaFrame for Instant Lab" may close your account at any time and without notice if we believe you have violated this Agreement. Following such termination, you will not be entitled to any refund for your purchases. After termination of your account, this Agreement will terminate, except for the following provisions which will continue to apply to you and "PolaFrame for Instant Lab": sections 4, 5, and 12 to 19.

4. Rights Granted to You by "PolaFrame for Instant Lab"

The "PolaFrame for Instant Lab" application grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use the Service. This license is for the sole purpose of allowing you to use and enjoy the benefits of the "PolaFrame for Instant Lab" application as authorized by this Agreement. Consequently, you agree to refrain from:

• using the Service or any content of the Service for any commercial purposes without our written consent;
• copying, modifying, transmitting, creating any derivative work, using or reproducing in any way any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content, or proprietary information accessible through the Service without the prior written consent of "PolaFrame for Instant Lab";
• expressing or implying that any of your statements are endorsed by "PolaFrame for Instant Lab";
• using any robot, digital agent, spider, crawler, scraper, site search/retrieval application, proxy gateway, or other manual or automatic device, method, or process to access, extract, index, data mine, or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents;
• using the Service in a manner that could interfere with, disrupt, or harm the Service, servers, or networks connected to the Service;
• uploading viruses or other malicious code or otherwise compromising the security of the Service;
• forging headers or otherwise manipulating identifiers to disguise the origin of any information transmitted on or through the Service;
• copying or reproducing any part of the Service without the prior written authorization of "PolaFrame for Instant Lab";
• using meta tags, code, or other devices containing any reference to the "PolaFrame for Instant Lab" application or the Service (or any trademark, trade name, service mark, logo, or slogan of "PolaFrame for Instant Lab") to direct any person to another website for any purpose;
• modifying, adapting, sublicensing, translating, selling, reverse engineering, decrypting, decompiling, or otherwise disassembling any portion of the Service, or causing others to do so;
• using or developing any applications that interact with the Service or the Content or information of other members without our written consent;
• using, accessing, or publishing the "PolaFrame for Instant Lab" application programming interface without our written consent;
• probing, scanning, or testing the vulnerability of our Service or any system or network;
• encouraging or promoting any activity that violates this Agreement.

The Company may investigate and take any available legal action in response to illegal and/or unauthorized uses of the Service, including account termination. Any software we provide may automatically download and install enhancements, updates, or other new functions. You can adjust these automatic downloads in your device settings.

5. Rights You Grant to "PolaFrame for Instant Lab"

By creating an account, you grant to "PolaFrame for Instant Lab" a worldwide, transferable, sub-licensable, and royalty-free license, and the right to host, store, use, copy, display, reproduce, adapt, modify, publish, and distribute all information you authorize us to access from Facebook, as well as the information you post, upload, display, or make available (collectively, "post") on the Service or transmit to other members (collectively, "Content").

The "PolaFrame for Instant Lab" license regarding your Content is non-exclusive, except for derivative works created through use of the Service, for which the "PolaFrame for Instant Lab" license will be exclusive. For example, in the case of Service screenshots featuring your Content, the license will be exclusive.

Furthermore, so that "PolaFrame for Instant Lab" can prevent the use of your Content outside of the Service, you authorize "PolaFrame for Instant Lab" to act on your behalf in the event of unauthorized use of your Content extracted from the Service by other members or third parties. Our license to your Content is governed by your rights under applicable law (for example, personal data protection laws to the extent the Content contains personal information as defined by those laws) and exists only for the limited purpose of developing, providing, managing, and improving the Service, as well as for research and development of other services.

You agree that any Content you place or authorize us to place on the Service may be seen by other members as well as by any person viewing or participating in the Service. You agree that all information submitted during account creation, including information submitted from your Facebook account, is accurate and truthful, and that you have the right to post the Content on the Service and to grant the aforementioned license to "PolaFrame for Instant Lab."

You understand and agree that we may monitor or review any Content you post as part of a Service. We may delete any Content, in whole or in part, if, in our sole judgment, it violates this Agreement or is likely to harm the reputation of the Service. When communicating with our customer service representatives, you agree to be respectful and kind. If we consider your behavior toward any of our customer service representatives or other employees to be threatening or abusive at any time, we reserve the right to immediately close your account.

In consideration for the authorization "PolaFrame for Instant Lab" grants you to use the Service, you agree that we, our affiliates, and our third-party partners may place advertisements on the Service. By submitting suggestions or feedback to "PolaFrame for Instant Lab" about our Services, you agree that "PolaFrame for Instant Lab" may use and share this feedback for any purpose without providing you compensation.

Please note that "PolaFrame for Instant Lab" may access, store, and disclose your account information and Content if required to do so by law, under this Agreement, or if we believe in good faith that such access, storage, or disclosure constitutes a legitimate interest to: (i) comply with legal process; (ii) enforce this Agreement; (iii) respond to claims that any Content violates the rights of third parties; (iv) respond to your customer service requests; or (v) protect the rights, property, or personal safety of the Company or any other person.

6. Community Rules

By using the Service, you agree to refrain from:

• using the Service for any purpose that is illegal or prohibited by this Agreement;
• using the Service for malicious or harmful purposes;
• using the Service to harm "PolaFrame for Instant Lab";
• requesting passwords for any purpose, or personally identifiable information for commercial or illegal purposes from other members, or spreading another person's personal information without their permission;
• using another member's account, sharing an account with another member, or possessing more than one account;
• creating another account if we have already terminated your account, unless you have our permission.

"PolaFrame for Instant Lab" reserves the right to investigate and/or close your account without refunding your purchases if you have violated this Agreement, misused the Service, or behaved in a way that "PolaFrame for Instant Lab" considers inappropriate or illegal, including actions or communications occurring outside the Service.

7. Content of Other Members

While "PolaFrame for Instant Lab" reserves the right to review and delete any Content that violates this Agreement, such Content is the sole responsibility of the member who posts it, and "PolaFrame for Instant Lab" cannot guarantee that all Content will comply with this Agreement. If you see Content on the Service that violates this Agreement, please report it by contacting us.

8. Purchases

At any time, "PolaFrame for Instant Lab" may offer products and services for purchase ("in-app purchases") via iTunes, Google Play, mobile carrier, direct billing from "PolaFrame for Instant Lab," or other payment platforms authorized by "PolaFrame for Instant Lab."

If you choose to make an in-app purchase, you must confirm that purchase through the applicable payment provider, and your payment method (whether your bank card or a third-party account like Google Play or iTunes) (your "Payment Method") will be charged for the in-app purchase at the price displayed for the selected service(s) plus any sales or other taxes that may be imposed on your payments, and you authorize "PolaFrame for Instant Lab" or the third-party payment account, as applicable, to charge you. If you purchase an automatically renewing periodic subscription through an in-app purchase, your Payment Method will be charged for the subscription until you cancel it.

After your commitment for an initial subscription period, and thereafter after any subsequent subscription period, your subscription will automatically renew for an equivalent additional period at the price you approved when subscribing. Subscriptions are automatically renewed until terminated or cancelled by you. When you subscribe, your Payment Method will be charged every month within 24 hours prior to the initial purchase date, at the price you accepted during initial subscription. Your bank card information will be stored and used later for automatic card payments in accordance with this Agreement.

If you wish to object to a payment already made, please contact us if you were billed directly by "PolaFrame for Instant Lab," or the relevant third-party payment account, such as iTunes for example. You may also object by contacting your bank or payment provider, who can provide further information on your rights and the applicable deadlines. You may unconditionally object to automatic bank card payments at any time by going to the "PolaFrame for Instant Lab" application settings or the third-party payment account, but note that you will still be obligated to pay any remaining amount.

To modify or terminate your subscription, you must log in to your third-party account (or go to your "PolaFrame for Instant Lab" account settings) and follow the instructions to terminate or cancel your subscription, even if you have deleted your "PolaFrame for Instant Lab" account or if you have deleted the "PolaFrame for Instant Lab" application from your device. Deleting your "PolaFrame for Instant Lab" account or the "PolaFrame for Instant Lab" application on your device does not result in termination or cancellation of your subscription. "PolaFrame for Instant Lab" will retain all funds collected from your Payment Method until you terminate or cancel your subscription on "PolaFrame for Instant Lab" or via the third-party account, as applicable. If you terminate or cancel your subscription, you may continue to use it until the end of the current subscription period. Your subscription will not be renewed at the end of that period.

Additional conditions via direct payment

If you pay "PolaFrame for Instant Lab" directly via your Payment Method: if you pay "PolaFrame for Instant Lab" directly, "PolaFrame for Instant Lab" may correct any billing error made even if payment has already been issued or received. In the event of a request for a refund or cancellation of a payment issued using your Payment Method, "PolaFrame for Instant Lab" may close your account immediately at its sole discretion. In the event of payment failure due to expiration, insufficient funds, or any other reason, and if you do not modify your Payment Method or terminate your subscription, you remain liable for any amount due and authorize us to continue charging your Payment Method when it is updated. Billing dates might be changed as a result. Payment terms depend on your Payment Method and may be determined by agreements between your bank, card issuer, or other provider of your Payment Method and you.

9. Refunds

In general, all fees for purchases are non-refundable and no refund or credit is possible for partially used periods. We may make an exception if a refund for a subscription offer is requested within fourteen days following the transaction date, or if the laws applicable in your jurisdiction provide for refunds. Subscribers residing in the EU or European Economic Area may, in accordance with local laws, benefit from a full refund during the 14 days following the start of their subscription, without needing to specify a reason. Please note that this 14-day period begins at the time of subscription.

To request a refund, please contact our customer service via the dedicated section in your application settings. Purchases of Virtual Items are FINAL AND NON-REFUNDABLE. If you registered with your Apple ID, refunds are processed by Apple and not by "PolaFrame for Instant Lab." To request a refund, go to iTunes, click on your Apple ID, select "Purchase History," find the transaction, and click "Report a Problem." You can also submit a request at https://getsupport.apple.com.

If you registered using your Google Play Store account or directly via "PolaFrame for Instant Lab": please contact us with your Google Play Store order number (you can find this number in the confirmation email you received or by logging in to Google Wallet) or your "PolaFrame for Instant Lab" order number (you can find this number in the confirmation email). If you use your right of withdrawal (except for purchases made via your Apple ID, which is managed by Apple), we will refund you (or ask Google to refund you) all payments we have received from you, without delay and within 14 days following the date on which we acknowledged receipt of your withdrawal request. This refund will be made using the same payment method you used for the initial transaction. In any case, no fees will be charged to you following this refund.

You cannot cancel an order for digital content that is not delivered on a physical medium if processing of the order has begun with your explicit consent and if you have been informed that you will lose your right of withdrawal by proceeding with that order. This condition applies, for example, to purchases of Virtual Items. Consequently, purchases are FINAL AND NON-REFUNDABLE.

10. Disclaimer

"PolaFrame for Instant Lab" PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" AND, TO THE EXTENT PERMITTED BY APPLICABLE LAW, GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE REGARDING THE SERVICE (INCLUDING ALL CONTENT THEREIN), INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

"PolaFrame for Instant Lab" DOES NOT REPRESENT OR WARRANT THAT (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, (B) ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED, OR (C) THAT ANY CONTENT OR INFORMATION YOU OBTAIN ON OR THROUGH THE SERVICES WILL BE ACCURATE. "PolaFrame for Instant Lab" ASSUMES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU, ANOTHER MEMBER, OR A THIRD PARTY POSTS, SENDS, OR RECEIVES VIA THE SERVICE. ACCESS TO ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE USE OF THE SERVICE IS AT YOUR OWN DISCRETION AND RISK.

11. Third-Party Services

The Service may contain advertisements and promotions offered by third parties as well as links to other websites or Internet resources. "PolaFrame for Instant Lab" will not be held responsible for the availability (or unavailability) of such external websites or resources. If you choose to interact with third parties made available through our Service, their relationship with you will be governed by the terms of those third parties. "PolaFrame for Instant Lab" will in no case be held responsible for the terms or actions of such third parties.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL "PolaFrame for Instant Lab," ITS AFFILIATES, EMPLOYEES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (I) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE, (II) THE CONDUCT OR CONTENT OF OTHER MEMBERS OR THIRD PARTIES ON, THROUGH, OR FOLLOWING USE OF THE SERVICES; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT, EVEN IF "PolaFrame for Instant Lab" HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL THE TOTAL LIABILITY OF "PolaFrame for Instant Lab" FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO "PolaFrame for Instant Lab" FOR THE SERVICE, AND 100 USD DURING YOUR PERIOD OF ACCOUNT OWNERSHIP. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, THEREFORE SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

13. Entire Agreement; Other

This Agreement, along with the Privacy Policy, Cookie Policy, and any terms disclosed and agreed to by you when you purchase additional features, products, or services we offer on the Service, contains the entire agreement between you and "PolaFrame for Instant Lab" regarding the use of the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement will continue in full force and effect.

The failure of the Company to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. You agree that your "PolaFrame for Instant Lab" account is non-transferable and all of your rights to your account and its Content terminate upon your death. No agency, joint venture, partnership, fiduciary, or other special relationship or employment is created as a result of this Agreement, and you may not make any representations on behalf of "PolaFrame for Instant Lab" or bind "PolaFrame for Instant Lab" in any manner.
